Warranty

Absolute Powerboats warrants to the original retail purchasers of its 2009 model boats if purchased from an authorized Absolute Powerboats dealer, and operated under normal, non-commercial use, that defects in material or workmanship that are reported within the applicable warranty periods will be repaired or replaced, subject to the remedies, exclusions, and limitations set out below.

Limited Structural Hull Warranty:  The selling dealer will repair any Structural Fiberglass Deck Or Hull Defect which is reported within five (5) years of the date of delivery to the original retail customer. The "Hull" shall mean the single fiberglass molded shell and integral structure within that shell below the hull flange/ gunwale, including stringers, floorboards and related structural reinforcements. The "Deck" shall mean the molded shell and integral fiberglass structural components above the hull flange/gunwale. A Structural Hull/Deck Defect shall mean a substantial defect in the Absolute Powerboats Hull/Deck which causes the Boat to be unfit or unsafe for general use as a pleasure craft under normal operating conditions.

Limited Parts Warranty:  The selling dealer will repair or replace any parts found to be defective in factory material or workmanship which are reported within one (1) year of the date of delivery of the Absolute Powerboat.

Laminate Blister Limited Warranty:  The selling dealer will repair any gel coat surface of the Hull that has laminate blisters which occurred as a result of defects in material and workmanship that are reported within three (3) years of the date of delivery or four (4) years from the date of manufacture, whichever is shorter, provided that the original factory gel coat surface has not been altered in any way such as accident repair, application of a coating other that marine bottom paint, or from improper surface preparation for paint, (i.e., excessive sanding or sandblasting, etc.), any of which will void this Limited Warranty. Absolute Powerboats shall repair laminate blisters based upon customary and reasonable charges not to exceed $230.00 per linear foot, with the method of repair subject to Absolute Powerboats prior approval.

Sole Remedy: In no event shall any repair or replacement under this Limited Warranty exceed the fair market value of the owner's boat as of the date of the owner's claim. THE REMEDY OF REPAIR OR REPLACEMENT OF PARTS THAT ARE FOUND TO BE DEFECTIVE IN FACTORY MATERIALS OR WORKMANSHIP COVERED BY THIS LIMITED WARRANTY SHALL CONSTITUTE THE OWNER'S SOLE AND EXCLUSIVE REMEDY AGAINST ABSOLUTE POWERBOATS FOR ANY CLAIMS WHATSOEVER OF ECONOMIC LOSS RESULTING FROM PRODUCT FAILURE. The terms and conditions contained herein may not be modified, altered or waived by any action, inaction, or representations, whether oral or in writing, except upon the express, written authority of a principal officer of Absolute Powerboats.

Statute of Limitations: Any action for rescission or revocation against Absolute Powerboats shall be barred unless it is commenced within one (1) year from the date of accrual of such cause of action.

What Is Not Covered?  This Warranty does not apply to: (1) engines, stern drives, controls, propellers, batteries, trailers or other equipment or accessories carrying their own individual warranties; (2) engines, parts or accessories not installed by Absolute Powerboats; (3) window breakage; (4) cosmetic gel coat and/or custom paint finish, i.e., fading, cracking, chips, scratches or crazing; (5) any Absolute Powerboats which has been altered, subjected to misuse, negligence or accident, or used for racing purposes; (6) any Absolute Powerboat boat which has been overpowered according to the maximum horsepower specifications on the capacity plate provided on each Absolute Powerboat outboard boat; (7) any Absolute Powerboat used for commercial purposes; (8) any defect caused by failure of the customer to provide reasonable care and maintenance; (9) fading or deterioration due to use, neglect, or aging of fabrics, canvas, and upholstery; (10) costs, charges, or monetary loss resulting from travel, haul-outs, inconvenience and/or other special, incidental or consequential damage of any kind or nature whatsoever, (11) any boat which has been salvaged or declared a total loss or a constructive total loss for any reason not covered by this limited warranty.

 Other Limitations: EXCEPT AS SET FORTH HEREIN OR ON ANY OTHER WRITTEN EXPRESS LIMITED WARRANTIES BY ABSOLUTE POWERBOATS, THERE ARE NO OTHER WARRANTIES EITHER EXPRESS OR IMPLIED PROVIDED BY ABSOLUTE POWERBOATS ON THIS BOAT. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF FITNESS AND MERCHANTABILITY, ARE EXPRESSLY EXCLUDED. ABSOLUTE POWRBOATS FURTHER DISCLAIMS ANY LIABILITY FOR ECONOMIC LOSS ARISING FROM CLAIMS OF PRODUCT FAILURE, NEGLIGENCE, DEFECTIVE DESIGN, MANUFACTURING DEFECT, FAILURE TO WARN AND/OR INSTRUCT, LACK OF SEAWORTHINESS, AND ANY OTHER THEORY OF LIABILITY NOT EXPRESSLY COVERED UNDER THE TERMS OF THIS LIMITED WARRANTY.

TO THE EXTENT REQUIRED BY LAW ANY IMPLIED WARRANTY OF MERCHANTABILITY IS LIMITED FOR THE DURATION OF THE RESPECTIVE EXPRESS LIMITED WARRANTIES STATED HEREIN. TO THE EXTENT ALLOWED BY LAW NEITHER ABSOLUTE POWERBOATS, NOR THE SELLING DEALER SHALL HAVE ANY RESPONSIBILITY FOR LOSS OF USE OF THE BOAT, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS OR CONSEQUENTIAL DAMAGES. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT BE APPLICABLE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT BE APPLICABLE. THIS WARRANTY GIVES THE OWNER SPECIFIC LEGAL RIGHTS, AND THE OWNER MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

 PURCHASERS IN THE EUROPEAN UNION (EU) MAY HAVE LEGAL RIGHTS UNDER APPLICABLE NATIONAL LEGISLATION GOVERNING THE SALE OF CONSUMER GOODS, WHICH ARE NOT AFFECTED BY THIS EXPRESS LIMITED TRANSFERABLE WARRANTY. Owner's Obligations: To obtain service under this Limited Warranty, contact your Absolute Powerboat dealer within the applicable warranty period. The owner is responsible for the expense associated with transporting the boat to and from the repair facility..

 Registration & Transferability:  
The non-expired term of this warranty may be transferred to a new owner upon the new owner's written request to Absolute Powerboats,  8679 N. State Hwy 5, Camdenton, Mo. 65020 and accompanied by the payment to Absolute Powerboats of fifty dollars ($50.00) .
